Legal Non-Conforming Application for Tax ID #17N04W32B022

    Richard Kennard, Owner, applied for a Determination of Legal Nonconforming Status (MSB 17.80 ) according to MSB 17.80.070 for a residential structure located on the shoreline of Crooked Lake, Alaska, Tax ID #17N04W32B022 . At its closest point, one structure is set back 49.4 feet from Crooked Lake. Structures are required to be set back a minimum of 75 feet from a waterbody. Granting a determination of Legal Nonconforming Status will permit the structure to remain in its current location.

    Comments are due on or before October 17, 2025, and will be included in the Staff Report to the Planning and Land Use Director. Please be advised that comments received from the public after that date will not be included in the staff report. The earliest decision date for this request is October 18, 2025.

    In order to be eligible to file an appeal from a decision of the Planning Director, a person must be designated an interested party. See MSB 15.39.010 for the definition of an interested party. The procedures governing appeals to the Board of Adjustment and Appeals are contained in MSB 15.39.010-250 , which is available on the Borough home page: matsu.gov , in the Borough Clerk’s office, and at various libraries within the borough.
